There are mainly 4 forms of title ownerships available in Cambodia
- Soft Title
- Hard Title
- LMAP Title
- CO-Ownership or Strata Title
Soft Title
- Soft titles are the most common form of property ownership in Cambodia, making up an estimated 75% of all holdings. These titles are registered at the local Sangkat (council) and Khan (district) level, but not at the national level. The administration of soft titles is managed by local authorities, allowing for fast (under 90 days) and low-cost transfers.
Hard Title
- Hard titles are the strongest form of land ownership in Cambodia, registered at the national Ministry of Land Management. Hard titles supersede soft titles, so some owners prefer them. Hard title transfers take around 12 weeks at the cadastral office and incur a 4% transfer tax based on official property valuation.
LMAP Title
- LMAP is a third type of land title in Cambodia, launched in 2002 with World Bank support. LMAP titles, like hard titles, are registered nationally and recognized by the Ministry of LandManagement. The key difference is LMAP titles have GPS-tagged property boundaries. LMAP title transfers also take ~12 weeks (about 3 months) and incur a 4% transfer tax based on official property valuation.
CO-Ownership or Strata Title
- Strata titles allow Khmer nationals and foreigners to co-own a property, but the property must meet certain criteria to be granted this co-ownership title
- New Buildings built in 2010 or later
- Foreigners can only own up to 70% of the total unit area
- Excludes ground and underground floors
- Properties can’t be within 30km of a land border
- Strata title co-ownership is recognized nationally by the Ministry of Land Management, Urban Planning and Construction. The transfer process takes around 12 weeks and costs 4% of the property’s value, as determined by a cadastral official.
